Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of fzreserve.com and any order you place with FZ Reserve, a sole proprietorship operated by Will Bodian (“FZ Reserve,” “we,” “us,” or “our”). By browsing the site, submitting an application, or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.

FZ Reserve produces merchandise on behalf of, and at the direction of, student organizations (for example, fraternities, sororities, and clubs). The organization is our client; FZ Reserve is not selling organization-branded goods to the general public.

By placing an order, you represent and warrant that you are a member of, or an authorized affiliate of, the student organization whose merchandise you are purchasing, and that the merchandise is for that organization’s and its members’ own use — not for resale to the general public. You agree not to acquire merchandise for the purpose of reselling it to non-members. We may decline or cancel any order we reasonably believe does not meet these conditions. If we cancel an order under this section before production begins, we will refund any amounts charged for that order.

Our merchandise is made-to-order and produced using print-on-demand methods. Items are not held in inventory; production of your order begins after your purchase is placed and payment is confirmed. Because each item is custom and produced specifically for you, please review your order carefully before submitting it. Estimated production and delivery timeframes are estimates, not guarantees.

Prices are shown at the time of order and are stated in U.S. dollars. Payments are processed by our third-party payment processor, Stripe; by placing an order you also agree to Stripe’s applicable terms. FZ Reserve does not store full payment card numbers. Applicable taxes and shipping charges may be added at checkout. We may correct pricing errors and cancel any affected order, refunding amounts charged for that order.

Many items display names, letters, logos, crests, insignia, or other marks belonging to a student organization (“Organization Marks”). When an organization directs FZ Reserve to produce items bearing its Organization Marks, that organization represents and warrants that it owns, or is authorized to use, those Organization Marks, and that our production of the items does not infringe the rights of any third party.

The organization agrees to indemnify, defend, and hold harmless FZ Reserve from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to the Organization Marks it directs us to produce. FZ Reserve’s own website content, design, and branding — including the FZ Reserve name and wordmark — are the property of FZ Reserve and may not be copied or used without permission.

Except as expressly stated in our Refund Policy, merchandise and the site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

To the fullest extent permitted by law, FZ Reserve will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to any order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you may have that cannot be limited or excluded under applicable law.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or any order will be brought exclusively in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes apply to orders placed after they are posted. Your continued use of the site or placement of a new order after changes are posted constitutes acceptance of the updated Terms.

Your use of the site is also governed by our Privacy Policy and our Refund Policy, which are incorporated into these Terms by reference.
